End-User License Agreement ("Agreement")

PLEASE READ THIS END-USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THE LEVVEN CONTROLS MOBILE APPLICATION ("APPLICATION").

BY CLICKING "I AGREE," DOWNLOADING, INSTALLING, OR USING THE APPLICATION, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT; (B) REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT (AT LEAST 18 YEARS OF AGE OR THE AGE OF MAJORITY IN YOUR JURISDICTION) OR THAT YOU HAVE THE VERIFIED CONSENT OF A PARENT OR GUARDIAN AS REQUIRED BY LAW; AND (C) ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE APPLICATION, AND DELETE IT FROM YOUR DEVICE.

This Agreement is a legal agreement between you (either an individual or a single entity) and Levven Electronics Ltd. ("Levven," "we," "us," or "our") and governs your use of the Application.

The Application is licensed, not sold, to you by Levven Electronics Ltd. for use strictly in accordance with the terms of this Agreement.

1. License

Levven grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with this Agreement.

2. Restrictions

You agree not to, and will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Application.
  • Copy or use the Application for any purpose other than as permitted under the License.
  • Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application.
  • Remove, alter, or obscure any proprietary notice of Levven or its licensors.

3. Age Verification and Parental Consent

3.1 Eligibility. The Application is not intended for users under the age of 18. By using the Application, you represent that you meet these age requirements.

3.2 Compliance with Youth Protection Laws. For users in jurisdictions with laws protecting minors, such as the Texas App Store Accountability Act (SB 2420), our grant of this license is expressly conditional upon age verification and parental consent processes managed by the app store platform (e.g., Apple App Store, Google Play Store).

3.3 Reliance on App Store Verification. We rely on age category and parental consent status information provided to us by the app store platform. For any user identified as a minor, the validity of this license is contingent upon the app store's provision of active, verified parental consent. If such consent is revoked by the parent or guardian, this license for that user will terminate immediately.

3.4 Use of Verification Data. You consent to our receipt and processing of age and consent data from the app store platform solely for the purposes of verifying eligibility, enforcing this Agreement, and complying with applicable law. We will handle this data as described in our Privacy Policy.

4. Intellectual Property

The Application, including all copyrights, patents, trademarks, trade secrets, and other intellectual property rights, is and shall remain the sole and exclusive property of Levven.

5. Your Suggestions

Any feedback, comments, ideas, or suggestions you provide regarding the Application shall become the sole property of Levven. We may use, copy, modify, publish, or redistribute these suggestions without any credit or compensation to you.

6. Modifications to Application

Levven reserves the right to modify, suspend, or discontinue the Application or any related service at any time, with or without notice.

7. Updates to Application

Levven may provide updates to the Application. You agree that we have no obligation to provide any updates. All updates are subject to the terms of this Agreement.

8. Third-Party Services

The Application may display or link to third-party content or services. You acknowledge that Levven is not responsible for any Third-Party Services. You access them at your own risk.

9. Privacy Policy

Your privacy is important to us. Levven's information collection, use, and sharing practices, including those related to age verification, are governed by our current Privacy Policy, available at: https://levven.com/privacy-policy. By accepting this Agreement, you consent to the data practices described in the Privacy Policy.

10. Term and Termination

This Agreement is effective until terminated by you or Levven. We may terminate it at any time for any reason. Your rights under this license will terminate automatically if you fail to comply with any term. Upon termination, you must cease all use and delete all copies of the Application.

11. Indemnification

You agree to indemnify and hold Levven harmless from any claims arising from your use of the Application, your violation of this Agreement, or your violation of any third-party rights.

12. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEVVEN DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, LEVVEN'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO LEVVEN FOR THE APPLICATION IN THE LAST 12 MONTHS. IN NO EVENT SHALL LEVVEN BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES.

14. Severability

If any provision of this Agreement is held invalid, the remainder of the Agreement will remain in full force and effect.

15. Amendments to This Agreement

Levven reserves the right to amend this Agreement. We will post the revised Agreement and update the "Last Updated" date. Material changes that affect user rights, including those required by laws like the Texas SB 2420 concerning age ratings, data practices, or monetization, will be communicated with at least 30 days' notice where practicable. Your continued use of the Application after changes constitutes acceptance of the new terms.

16. Governing Law

This Agreement is governed by the laws of the Province of Alberta, Canada, excluding its conflict of law rules. Your use may also be subject to local, state, national, or international laws.

18. Entire Agreement

This Agreement constitutes the entire agreement between you and Levven concerning the Application.

EN CLIQUANT SUR « J’ACCEPTE », EN TÉLÉCHARGEANT, INSTALLANT OU UTILISANT L’APPLICATION, VOUS (A) RECONNAISSEZ AVOIR LU ET COMPRIS CE CONTRAT; (B) DÉCLAREZ AVOIR L’ÂGE LÉGAL POUR CONCLURE UN CONTRAT CONTRAIGNANT (AU MOINS 18 ANS OU L’ÂGE DE LA MAJORITÉ DANS VOTRE JURIDICTION) OU AVOIR LE CONSENTEMENT VÉRIFIÉ D’UN PARENT OU TUTEUR TEL QUE REQUIS PAR LA LOI; ET (C) ACCEPTEZ CE CONTRAT ET CONVENEZ D’ÊTRE LÉGALEMENT LIÉ(E) PAR SES CONDITIONS. Le présent Contrat constitue un accord légal entre vous (une personne physique ou une entité unique) et Levven Electronics Ltd. (« Levven », « nous », « notre ») et régit votre utilisation de l’Application.

L’Application vous est concédée sous licence, et non vendue, par Levven Electronics Ltd. pour une utilisation strictement conforme aux conditions du présent Contrat.

1. Licence

Levven vous accorde une licence révocable, non exclusive, non transférable et limitée pour télécharger, installer et utiliser l’Application strictement conformément au présent Contrat.

2. Restrictions

Vous acceptez de ne pas, et de ne pas permettre à d’autres de :

  • Accorder une sous-licence, vendre, louer, donner en location, céder, distribuer, transmettre, héberger, sous-traiter, divulguer ou autrement exploiter commercialement l’Application.
  • Copier ou utiliser l’Application à toute fin autre que celles permises par la Licence.
  • Modifier, créer des œuvres dérivées, désassembler, décrypter, décompiler ou procéder à l’ingénierie inverse de toute partie de l’Application.
  • Retirer, modifier ou masquer tout avis de propriété de Levven ou de ses concédants de licence.

3. Vérification de l’âge et consentement parental

3.1 Admissibilité. L’Application n’est pas destinée aux utilisateurs de moins de 18 ans. En utilisant l’Application, vous déclarez respecter ces exigences d’âge.

3.2 Conformité aux lois de protection des jeunes. Pour les utilisateurs se trouvant dans des juridictions ayant des lois protégeant les mineurs, telles que la Texas App Store Accountability Act (SB 2420), l’octroi de cette licence est expressément conditionnel aux processus de vérification de l’âge et de consentement parental gérés par la plateforme de magasin d’applications (p. ex., Apple App Store, Google Play Store).

3.3 Dépendance à la vérification du magasin d’applications. Nous nous appuyons sur la catégorie d’âge et le statut de consentement parental fournis par la plateforme. Pour tout utilisateur identifié comme mineur, la validité de la présente licence dépend du consentement parental actif et vérifié fourni par le magasin d’applications. Si ce consentement est révoqué par un parent ou un tuteur, cette licence prendra fin immédiatement pour cet utilisateur.

3.4 Utilisation des données de vérification. Vous consentez à ce que nous recevions et traitions les données d’âge et de consentement provenant de la plateforme uniquement aux fins de vérifier l’admissibilité, d’appliquer le présent Contrat et de respecter la loi applicable. Nous traiterons ces données conformément à notre Politique de confidentialité.

4. Propriété intellectuelle

L’Application, y compris tous les droits d’auteur, brevets, marques de commerce, secrets commerciaux et autres droits de propriété intellectuelle, est et demeure la propriété unique et exclusive de Levven.

5. Vos suggestions

Tout commentaire, idée ou suggestion que vous fournissez concernant l’Application devient la propriété exclusive de Levven. Nous pouvons utiliser, copier, modifier, publier ou redistribuer ces suggestions sans vous accorder de crédit ni de compensation.

6. Modifications à l’Application

Levven se réserve le droit de modifier, suspendre ou interrompre l’Application ou tout service connexe à tout moment, avec ou sans préavis.

7. Mises à jour de l’Application

Levven peut fournir des mises à jour à l’Application. Vous acceptez que nous n’ayons aucune obligation de fournir des mises à jour. Toutes les mises à jour sont régies par les conditions du présent Contrat.

8. Services tiers

L’Application peut afficher ou contenir des liens vers du contenu ou des services de tiers. Vous reconnaissez que Levven n’est pas responsable de tout service tiers. Vous y accédez à vos propres risques.

9. Politique de confidentialité

Votre vie privée est importante pour nous. Les pratiques de Levven en matière de collecte, d’utilisation et de partage de renseignements, y compris celles liées à la vérification de l’âge, sont régies par notre Politique de confidentialité actuelle, disponible à : https://levven.com/privacy-policy. En acceptant le présent Contrat, vous consentez aux pratiques décrites dans la Politique de confidentialité.

10. Durée et résiliation

Le présent Contrat demeure en vigueur jusqu’à ce qu’il soit résilié par vous ou par Levven. Nous pouvons le résilier à tout moment, pour quelque raison que ce soit. Vos droits en vertu de cette licence prendront fin automatiquement si vous ne respectez pas une condition. À la résiliation, vous devez cesser toute utilisation et supprimer toutes les copies de l’Application.

11. Indemnisation

Vous acceptez d’indemniser Levven et de la tenir indemne de toute réclamation découlant de votre utilisation de l’Application, de votre violation du présent Contrat ou de la violation de droits de tiers.

12. Exclusion de garanties

L’APPLICATION EST FOURNIE « TELLE QUELLE » ET « SELON SA DISPONIBILITÉ », AVEC TOUS SES DÉFAUTS. DANS LA MESURE MAXIMALE PERMISE PAR LA LOI, LEVVEN DÉCLINE TOUTE GARANTIE, EXPRESSE OU IMPLICITE, Y COMPRIS LES GARANTIES DE QUALITÉ MARCHANDE, D’ADAPTATION À UN USAGE PARTICULIER ET D’ABSENCE DE CONTREFAÇON.

13. Limitation de responsabilité

DANS LA MESURE MAXIMALE AUTORISÉE PAR LA LOI, LA RESPONSABILITÉ TOTALE DE LEVVEN ENVERS VOUS POUR TOUTE RÉCLAMATION DÉCOULANT DU PRÉSENT CONTRAT NE DÉPASSERA PAS LE MONTANT QUE VOUS AVEZ PAYÉ À LEVVEN POUR L’APPLICATION AU COURS DES 12 DERNIERS MOIS. EN AUCUN CAS LEVVEN NE SERA RESPONSABLE DE DOMMAGES INDIRECTS, CONSÉCUTIFS OU ACCESSOIRES.

14. Divisibilité

Si une disposition du présent Contrat est jugée invalide, le reste du Contrat demeurera pleinement en vigueur.

15. Modifications au présent Contrat

Levven se réserve le droit de modifier le présent Contrat. Nous publierons la version révisée et mettrons à jour la date de « Dernière mise à jour ». Les changements importants qui affectent les droits des utilisateurs, y compris ceux requis par des lois comme la Texas SB 2420 concernant les cotes d’âge, les pratiques relatives aux données ou la monétisation, seront communiqués avec un préavis d’au moins 30 jours lorsque cela est raisonnablement possible. Votre utilisation continue de l’Application après les changements constitue votre acceptation des nouvelles conditions.

16. Droit applicable

Le présent Contrat est régi par les lois de la province de l’Alberta, Canada, à l’exclusion de ses règles relatives aux conflits de lois. Votre utilisation peut également être assujettie à des lois locales, provinciales, nationales ou internationales.

18. Intégralité du Contrat

Le présent Contrat constitue l’entente intégrale entre vous et Levven concernant l’Application.

POR FAVOR LEA ESTE ACUERDO DE LICENCIA DE USUARIO FINAL ("ACUERDO") CUIDADOSAMENTE ANTES DE DESCARGAR, INSTALAR O USAR LA APLICACIÓN MÓVIL LEVVEN CONTROLS ("APLICACIÓN").

AL HACER CLIC EN "ACEPTO", DESCARGAR, INSTALAR O UTILIZAR LA APLICACIÓN, USTED (A) RECONOCE QUE HA LEÍDO Y ENTENDIDO ESTE ACUERDO; (B) DECLARA QUE TIENE LA EDAD LEGAL PARA CELEBRAR UN ACUERDO VINCULANTE (AL MENOS 18 AÑOS DE EDAD O LA MAYORÍA DE EDAD EN SU JURISDICCIÓN) O QUE CUENTA CON EL CONSENTIMIENTO VERIFICADO DE UN PADRE O TUTOR SEGÚN LO REQUIERA LA LEY; Y (C) ACEPTA ESTE ACUERDO Y ACEPTA ESTAR LEGALMENTE OBLIGADO(A) POR SUS TÉRMINOS. SI NO ACEPTA ESTOS TÉRMINOS, NO DESCARGUE, INSTALE NI UTILICE LA APLICACIÓN, Y ELIMÍNELA DE SU DISPOSITIVO.

Este Acuerdo es un acuerdo legal entre usted (ya sea una persona física o una sola entidad) y Levven Electronics Ltd. ("Levven", "nosotros", "nos" o "nuestro") y rige su uso de la Aplicación.

1. Licencia

Levven le otorga una licencia revocable, no exclusiva, no transferible y limitada para descargar, instalar y usar la Aplicación estrictamente de acuerdo con este Acuerdo.

2. Restricciones

Usted acepta no, y no permitirá que otros:

  • Otorguen licencias, vendan, alquilen, arrienden, asignen, distribuyan, transmitan, hospeden, subcontraten, divulguen o exploten comercialmente la Aplicación de cualquier otra forma.
  • Copien o utilicen la Aplicación para cualquier propósito distinto al permitido bajo la Licencia.
  • Modifiquen, creen obras derivadas, desensamblen, descifren, recompilen o realicen ingeniería inversa de cualquier parte de la Aplicación.
  • Eliminen, alteren u oculten cualquier aviso de propiedad de Levven o de sus licenciantes.

3. Verificación de edad y consentimiento parental

3.1 Elegibilidad. La Aplicación no está destinada a usuarios menores de 18 años. Al utilizar la Aplicación, usted declara que cumple con estos requisitos de edad.

3.2 Cumplimiento con leyes de protección de menores. Para usuarios en jurisdicciones con leyes que protegen a los menores, como la Texas App Store Accountability Act (SB 2420), el otorgamiento de esta licencia es expresamente condicional a los procesos de verificación de edad y consentimiento parental gestionados por la plataforma de la tienda de aplicaciones (por ejemplo, Apple App Store, Google Play Store).

3.3 Dependencia de la verificación de la tienda de aplicaciones. Nos basamos en la categoría de edad y el estado del consentimiento parental proporcionados por la plataforma. Para cualquier usuario identificado como menor, la validez de esta licencia depende de que la tienda de aplicaciones proporcione un consentimiento parental activo y verificado. Si dicho consentimiento es revocado por el padre o tutor, esta licencia para ese usuario terminará inmediatamente.

3.4 Uso de datos de verificación. Usted consiente que recibamos y procesemos los datos de edad y consentimiento de la plataforma de la tienda de aplicaciones únicamente con el propósito de verificar elegibilidad, hacer cumplir este Acuerdo y cumplir con la ley aplicable. Trataremos estos datos según lo descrito en nuestra Política de Privacidad.

4. Propiedad intelectual

La Aplicación, incluyendo todos los derechos de autor, patentes, marcas registradas, secretos comerciales y demás derechos de propiedad intelectual, es y seguirá siendo propiedad única y exclusiva de Levven.

5. Sus sugerencias

Cualquier comentario, idea o sugerencia que proporcione con respecto a la Aplicación se convertirá en propiedad exclusiva de Levven. Podemos usar, copiar, modificar, publicar o redistribuir estas sugerencias sin otorgarle crédito ni compensación.

6. Modificaciones a la Aplicación

Levven se reserva el derecho de modificar, suspender o discontinuar la Aplicación o cualquier servicio relacionado en cualquier momento, con o sin aviso.

7. Actualizaciones de la Aplicación

Levven puede proporcionar actualizaciones de la Aplicación. Usted acepta que no tenemos obligación de proporcionar actualizaciones. Todas las actualizaciones están sujetas a los términos de este Acuerdo.

8. Servicios de terceros

La Aplicación puede mostrar o enlazar a contenido o servicios de terceros. Usted reconoce que Levven no es responsable de ningún Servicio de Terceros. Usted accede a ellos bajo su propio riesgo.

9. Política de privacidad

Su privacidad es importante para nosotros. Las prácticas de Levven relacionadas con la recopilación, uso y compartición de información, incluidas las relacionadas con la verificación de edad, se rigen por nuestra Política de Privacidad vigente, disponible en: https://levven.com/privacy-policy. Al aceptar este Acuerdo, usted consiente las prácticas de datos descritas en la Política de Privacidad.

10. Plazo y terminación

Este Acuerdo estará vigente hasta que sea terminado por usted o por Levven. Podemos terminarlo en cualquier momento por cualquier motivo. Sus derechos bajo esta licencia terminarán automáticamente si no cumple con cualquier término. Al terminar, debe dejar de usar y eliminar todas las copias de la Aplicación.

11. Indemnización

Usted acepta indemnizar y mantener indemne a Levven por cualquier reclamación que surja de su uso de la Aplicación, su violación de este Acuerdo o su violación de cualquier derecho de terceros.

12. Exención de garantías

LA APLICACIÓN SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD" CON TODAS SUS FALLAS. EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, LEVVEN RECHAZA TODAS LAS GARANTÍAS, YA SEAN EXPRESAS O IMPLÍCITAS, INCLUYENDO GARANTÍAS DE COMERCIABILIDAD, IDONEIDAD PARA UN PROPÓSITO PARTICULAR Y NO INFRACCIÓN.

13. Limitación de responsabilidad

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, LA RESPONSABILIDAD TOTAL DE LEVVEN ANTE USTED POR CUALQUIER RECLAMACIÓN DERIVADA DE ESTE ACUERDO NO EXCEDERÁ EL MONTO QUE USTED HAYA PAGADO A LEVVEN POR LA APLICACIÓN EN LOS ÚLTIMOS 12 MESES. EN NINGÚN CASO LEVVEN SERÁ RESPONSABLE POR DAÑOS INDIRECTOS, CONSECUENTES O INCIDENTALES.

14. Divisibilidad

Si alguna disposición de este Acuerdo se considera inválida, el resto del Acuerdo permanecerá en pleno vigor y efecto.

15. Enmiendas a este Acuerdo

Levven se reserva el derecho de enmendar este Acuerdo. Publicaremos el Acuerdo revisado y actualizaremos la fecha de "Última actualización". Los cambios materiales que afecten los derechos del usuario, incluyendo los requeridos por leyes como la Texas SB 2420 sobre clasificaciones de edad, prácticas de datos o monetización, se comunicarán con al menos 30 días de aviso cuando sea posible. Su uso continuado de la Aplicación después de los cambios constituye aceptación de los nuevos términos.

16. Ley aplicable

Este Acuerdo se rige por las leyes de la Provincia de Alberta, Canadá, excluyendo sus normas sobre conflicto de leyes. Su uso también puede estar sujeto a leyes locales, estatales, nacionales o internacionales.
